Sept. 19, 2000 For more information, contact Melinda Carl, Information and Education, 302-739-4506 DNREC Issues Final Findings and Order Settling Laidlaw AllegationsThe Department of Natural Resources and Environmental Control has issued a Final Findings and Order settling alleged violations of Laidlaw Corporations air emissions permit. Laidlaw operates a manufacturing facility at 300 Pigeon Point Road in New Castle where it manufactures coated wire clothes hangers. On Feb. 24, 2000, DNREC issued the company a Notice of Administrative Penalty Assessment with $40,000 penalty alleging violations of its air emissions permit discovered during various inspections of the facility, and review of its emissions reporting of volatile organic compounds (VOCs). The alleged VOC violations related to operating hours for coating operations. During a review of Laidlaws operations and the assumptions underlying the companys permit, it was determined that the company made a number of operational changes to reduce its emissions, and subsequently DNREC and Laidlaw agreed to settle the alleged violations. Under the Final Findings and Order by DNREC Secretary Nicholas A. DiPasquale: The Notice of Administrative Penalty (including any and all claims or violations alleged) is withdrawn. Laidlaw will pay $25,000 as a penalty and $5,000 for costs of investigating the allegations. Laidlaw will submit an application for an amendment to its Title V Permit for VOC emission rates from its coating operations within 90 days. Also, in exchange for payment of the penalty and commitments by Laidlaw and pending review of the companys application for a permit amendment and issuance of the amended permit, DNREC will release the company from liability arising out of any violation related only to its coatings operations predating issuance of the amended permit with certain conditions.
