Rite Off, Inc. Assessed $25,000 Penalty For Hazardous Waste Violations

Rite Off, Inc. was issued a Notice of Administrative Penalty Assessment and Order with a penalty of $25,000 Sept. 1 by DNREC Secretary Nicholas A. DiPasquale. The Order was issued for violations of Delaware’s hazardous waste regulations.

Rite Off, Inc., a large quantity generator of hazardous waste, is located in the Seaford Industrial Park in Seaford.

A December 1999 compliance assessment revealed several violations and was followed by a Notice of Violation. The Notice of Violation issued on Jan. 11, 2000 to Rite Off, Inc. required the company to return to compliance within 30 days. Rite Off failed to return to compliance as directed. Violations included:

  • failure to properly label containers used to accumulate hazardous waste by clearly marking each container with the words, "Hazardous Waste;"
  • failure to initiate shipments of hazardous waste within 90 days without first obtaining a permit or an extension;
  • failure to provide adequate aisle space for inspection and for unobstructed movement of emergency response personnel;
  • failure to manage containers used to accumulate hazardous waste in a manner so as to prevent a release or spill; and
  • failure to submit the proper notification form to the Department when the facility’s contact person changed.

All the violations were related to waste management procedures and none resulted in a release of hazardous waste to the environment.

The Secretary’s Order requires Rite Off, within 10 days, to submit a State of
Delaware Notification of Regulated Waste Activity Form that accurately addresses the current hazardous waste management practices at the facility. It also requires payment of the $25,000 penalty within 30 days.

Rite Off, Inc. has 30 days to request a public hearing on the violations.
