August 24, 2000 (Corrected August 29, 2000) For more information, contact Karen JAnthony, Waste Management, 302-739-3689, or Melinda Carl or Donald White, Information and Education, 302-739-4506 ACM Services Company Assessed $55,000 Penalty for Hazardous Waste ViolationsACM Services Company, LLC, located in Wilmington, was issued a Notice of Administrative Penalty Assessment and Order with a penalty of $55,000 Aug. 23 by DNREC Secretary Nicholas A. DiPasquale. The Order was issued for violations of Delawares solid and hazardous waste regulations. ACM, a large quantity generator of hazardous waste, was created through a joint venture between Hazardous Materials Management Team, Ltd. and Omnichem, Inc. in 1997. Since 1995, six of seven compliance assessments revealed violations. The Department issued Notices of Violation requiring that compliance be achieved within 30 days of the inspections. ACM returned to full compliance after each Notice of Violation through 1997 and achieved partial compliance in 1998. DNREC sought administrative action and penalty when it was determined in February 1999 that the company again violated hazardous waste regulations. "Although ACM came into compliance with prior solid and hazardous waste violations, their behavior demonstrates a consistent pattern of repeated violations," said Secretary DiPasquale. "This penalty action is intended to send a clear message to ACM that we expect them to improve their performance." DiPasquale also noted that all the violations were related to waste management procedures and none resulted in a release of hazardous waste to the environment. In the Order, ACM is cited for 22 violations in February 1999, two of which also occurred in January 1998. The violations ranged from failing to properly test potentially hazardous waste material to failing to properly dispose of hazardous waste and include: not managing hazardous waste containers in a manner to minimize potential for release, failing to clearly mark or label containers; failing to have external liner systems for hazardous waste tanks that are free of cracks or gaps; and failing to have appropriate controls to prevent overflows from hazardous waste accumulation tanks. ACM Services remains subject to further assessments for hazardous waste violations that may continue to occur after the date of the Order.
