DNREC Issues $20,000 Penalty Assessment and Order to Eastern Shore Natural Gas Company

Eastern Shore Natural Gas Company, a natural gas transmission subsidiary of Chesapeake Utilities, was issued a Notice of Administrative Penalty Assessment and Order with a penalty of $20,000 yesterday by DNREC Secretary Nicholas A. DiPasquale.

The Order was issued for violations of Delaware’s regulations governing the control of air pollution. Eastern Shore constructed a gas compressor unit at its facility on School House Road and Route 72 in Delaware City prior to receiving a construction permit.

Eastern Shore Natural Gas Company is responsible for transporting natural gas through an interstate pipeline to customers throughout Delaware and Maryland’s Eastern Shore.

During a site visit at the facility on November 8, 1999, the Department discovered that the concrete pad for the compressor unit had been poured on August 30, 1999, and the unit was delivered and installed on September 17, 1999. The unit was fully operational at that time, but was not running due to low demand.

The original application for construction of the compressor unit was filed February 19, 1999 and the Department did not issue a permit approving the construction until November 29, 1999.
