DuPont de Nemours & Co.E.I. DuPont de Nemours & Company was issued a Notice of Administrative Penalty Assessment and final Order carrying a penalty assessment of $40,000 signed by Department of Natural Resources and Environmental Control Secretary Nicholas A. DiPasquale. The Order and penalty assessment represents a final agreement between DNREC and the company for discharges of pollutants in violation of its National Pollutant Discharge Elimination System (NPDES) permit and Regulations Governing the Control of Water Pollution. I believe this final agreement and $40,000 penalty is a fair and equitable resolution of these water pollution violations, said Secretary DiPasquale. Whenever we can come to an equitable agreement regarding penalty assessments, we avoid the expense of costly of litigation. The company has acknowledged and corrected the violations. E.I. DuPont de Nemours & Company owns and operates a facility on Hay Road in Edge Moor, Wilmington, where it manufactures titanium dioxide, ferric chloride and titanium tetrachloride. The company obtained an NPDES permit in 1989 from DNREC for discharging effluent to the Delaware River. The permit was amended in 1990 and 1993. Enforcement of the NDPES permit program under the federal Water Pollution Control Act (Clean Water Act) has been delegated to the State of Delaware by the federal government. During 1998 and 1999, the company reported effluent violations in its discharge monitoring reports for iron and tss (total suspended solids) at Outfall (discharge) 001; violations of pH at Outfall 002 during 1999; and violations for pH at Outfall 003 during 1998 and 1999. The violations at the facility were due to improper operation and process overloads to the wastewater plant. The company has since returned to compliance. An earlier Notice of Administrative Penalty Assessment and Order dated March 8 issued to E.I. DuPont de Nemours & Company with a penalty assessment of $47,000 was withdrawn by Secretary DiPasquale with issuance of the final Order. -30- Document no. 40-01/00/06/21 |
