Taylor or Melinda Carl, Information and Education, 302-739-4506 DNREC Issues Amended Penalty Assessment and Order to Port ContractorsDepartment of Natural Resources and Environmental Control Secretary Nicholas A. DiPasquale issued a final settlement and amended administrative penalty to Port Contractors, Inc. April 13. Port Contractors, Inc. is a bulk cargo handling and storage facility located at 529 Terminal Avenue in New Castle. According to the final agreement, Port Contractors will pay a $7,000 penalty. The first $1000 is deemed a contribution to "The Delaware Envirothon." The remaining $6,000 is designated as a penalty assessment. The settlement agreement suspended $6,000 of the originally proposed $13,000 penalty. That $6,000 will be forgiven if the company does not violate applicable laws, regulations or permit conditions for a period of one year. Port Contractors receives shipments of petroleum coke for transport, storage and subsequent shipment as a part of normal business operations. In December 1999, DNREC cited the company for the handling of petroleum coke outside the confines of a warehouse without having obtained a permit from the Department. The company's operation of loading, unloading and stockpiling petroleum coke - an activity which may cause or contribute to the discharge of an air contaminant - was in violation of Delaware's regulations on air pollution control. The violations occurred for a period beginning Oct. 15, 1998 through Oct. 19, 1998. The Delaware Envirothon is an environmental education program for high school students, which culminates in an annual competitive, problem-solving event held in the spring.
