Notice Served on ICI Americas, Inc. of $5,000 Administrative Penalty
The Department of Natural Resources and Environmental Control served
notice on ICI Americas, Inc. today that it is assessing a $5,000 administrative
penalty for violations at its facility, known as the Atlas Point Plant,
located at 315 Cherry Lane, New Castle.
In a Notice of Administrative Penalty Assessment and Secretary's Order,
ICI Americas, Inc., was found to have violated conditions of its air
permit by exceeding the permit limitations and failing to report those
emissions to the Department.
DNREC investigated an emergency release Oct. 27, 1998 at the ICI facility
and determined that approximately 6,000 pounds of isosorbide (a sugar)
decomposition products had been emitted into the atmosphere. An incident
report received Nov. 24, 1998 indicated the release consisted of the
isosorbide decomposition products in the form of water, carbon dioxide,
carbon monoxide, and ash, and that the release was determined to be
non-hazardous.
The Penalty Assessment and Order signed by DNREC Secretary Nicholas
A. DiPasquale will become final 30 days from ICI's receipt of notice
today, March 24, unless the company requests a public hearing on the
violations.
