DNREC Settles Hazardous Waste Violations with ACM ServicesDepartment of Natural Resources and Environmental Control Secretary Nicholas A. DiPasquale has entered into a settlement agreement with ACM Services Company L.L.C. regarding ACM's 1999 hazardous waste violations while operating as a large quantity generator, a resource recovery facility and solid waste facility as a tenant at Suites 8 and 9, 1603 Jessup St., Wilmington. Under the settlement agreement, ACM Services will pay a $25,000 penalty and $2,500 in recovery costs, and has withdrawn its appeal of a penalty assessment. The agreement does not relieve ACM of responsibility to comply with any federal, state or local laws or regulations. ACM was issued a Notice of Administrative Penalty Assessment and Order by the Department Aug. 21, 2000, and assessed a penalty of $55,000 for 22 violations. The violations ranged from failing to properly test potentially hazardous waste material to failing to properly dispose of hazardous waste. All of the violations were related to waste management procedures and none resulted in a release of hazardous waste to the environment. Since issuance of the penalty assessment Order, ACM has made substantial improvements at the facility to comply with legal requirements. ACM has also now closed the facility in compliance with a closure plan dated Dec. 21, 2000, and the landlord reportedly intends to sell the facility. The Department is in the process of issuing a closure certification for the facility. -30- |
