Notice of Conciliation Proceedings Served on Frederick Voshell and Refuge Run Corporation for Solid Waste Violations

Department of Natural Resources and Environmental Control Secretary Nicholas A. DiPasquale has issued a Notice of Conciliation Proceedings and Order to Frederick A. Voshell of Delaware and Refuge Run Corporation for unapproved and unpermitted solid waste disposal activities.

Refuge Run Corporation owns property on Mud Mill Road, Camden, Del., a portion of which was formerly known as Leisure Haven Mobile Home Park. During the past several years, DNREC representatives discovered unapproved recycling and unpermitted solid waste disposal and storage activity at the mobile home site.

The former mobile home park and associated property contain approximately 30 condemned mobile homes, abandoned cars, above-ground heating oil tanks, propane cylinders and municipal solid waste.

On Oct. 6, 1998, DNREC issued a Notice of Conciliation and Secretary's Order to the former site owner, Ms. Mary Ellen Heller. To date, that Order is outstanding and in force for violations at the site. Since issuance of the 1998 Order, additional solid wastes have been dumped at the site, including household trash.

The Order issued Feb. 5, 2001 requires Refuge Run Corporation to perform the following immediate cleanup actions at the Willow Grove property within two weeks of the effective date of the Order:

  • Remove and properly dispose of the municipal solid waste piles near the mailbox area and around the condemned mobile homes to prevent vermin, leachate production and other public health concerns; and to discourage illegal public dumping.
  • Restrict access to the site with a chain or fence at all entrances and post "No Trespassing" signs at these entrances; and
  • Remove all heating oil tanks and gas cylinders for reuse or proper disposal.

In addition, Refuge Run has been ordered to submit a work plan to the Department for cleanup of the site within 90 days of the effective date of the Order. The work plan must be submitted for review and approval to DNREC's Division of Air and Waste Management, Solid and Hazardous Waste Management Branch. The plan is to include a detailed inventory of the waste on the entire site, a timetable (not to exceed 12 months) for removal of all wastes from the site, and a list of transporter and disposal facilities that will be utilized.

Refuge Run was also ordered to report progress of the site cleanup to the Department on a monthly basis.

Voshell and Refuge Run Corporation have 30 days to request a public hearing.
