DNREC Settles Alleged Air Pollution Violations with
Reichhold, Inc.
Company Agrees to $25,000 Penalty and $150,000 Environmental Project
The Department of Natural Resources and Environmental Control and Reichhold,
Inc., located in Dover, Del., have entered into a settlement agreement
regarding a May 10, 2000 Notice of Administrative Penalty Assessment
for alleged violations of Delaware's air pollution control regulations.
Under terms of the Settlement Agreement and Amended Order, Reichhold
has agreed to complete a supplemental environmental project (SEP) at
a cost of not less than $150,000. Reichhold also will pay DNREC a monetary
penalty of $25,000 plus an additional $5,000 for investigative costs.
The SEP is beyond what is required by law or regulation and is designed
to make an environmental improvement in the facility. The project will
provide a central tanker truck unloading station with a secondary containment
area for vinyl acetate, methyl methacrylate, butyl acrylate, ethyl acrylate,
ammonium hydroxide, and sodium hydroxide at the Reichhold Dover facility.
In the May 10, 2000 Secretary's Order with penalty assessment of $123,000,
the Department determined that Reichhold was in violation by causing
or contributing to the discharge of excessive air contaminants by failing
to comply with leak detection and repair requirements, and by failing
to submit an application to amend a permit in the required time frame.
The Department and Reichhold will submit the settlement to Superior
Court in New Castle County for the purpose of enforcing the provisions
of the Settlement Agreement and Amended Order.
Completion date for the SEP is July 1, 2001. If Reichhold's allowable
costs for the SEP do not equal or exceed the $150,000, the company will
be required to pay the difference to DNREC as a penalty.
