DNREC Settles Alleged Air Permit Violations with Honeywell
Company Agrees to $21,000 Penalty and $42,000 Environmental Project
The Department of Natural Resources and Environmental Control and
Honeywell International, Inc., Morristown, N.J., have entered into a
settlement agreement resolving air permit violations alleged to have
occurred at Honeywell's Claymont, Del. facility.
Under terms of the settlement, Honeywell will pay a penalty of $21,000
and will offset a portion of an earlier DNREC penalty assessment by
developing an ISO-14001 compliant (International Organization for Standardization)
Environmental Management System for the Claymont facility. The system
is proposed to enhance the company's ability to achieve compliance with
all applicable federal, state and local environmental laws and regulations
at the facility. The contractual cost to Honeywell for the project will
be no less than $42,000
In October 1999, DNREC Secretary Nicholas A. DiPasquale issued a Notice
of Administrative Penalty Assessment and Order with a penalty of $42,000
to AlliedSignal, Inc. for alleged violations of Delaware's air pollution
regulations concerning installation of equipment at its specialty chemical
business located at 6100 Philadelphia Pike in Claymont. AlliedSignal
changed its name to Honeywell effective Dec. 1, 1999.
The Environmental Management System is part of the overall management
system, which includes organizational structure, planning activities,
responsibilities, practices, procedures, processes and resources for
developing, implementing, achieving, reviewing and maintaining the environmental
policy. Honeywell will formally apply for ISO certification of its Environmental
Management System for the Claymont facility after all of the terms of
the settlement agreement have been met.
Performance of the settlement agreement, including development of the
environmental project, will be required by any purchasers or successors
to Honeywell's specialty chemical business at the Claymont facility.
