DNREC Issues Order Settling Atlantic Aviation Alleged Violations; Company Agrees to $17,500 Penalty, $80,000 Environmental Project

Department of Natural Resources and Environmental Control Secretary Nicholas A. DiPasquale announced today the signing of a negotiated Settlement Agreement and Order with Atlantic Aviation Corporation. Atlantic Aviation's business operations range from routine aircraft fueling and cleaning to major modification and repair of general and corporate aircraft.

The Settlement Agreement and Order resolves alleged violations by Atlantic Aviation of various provisions of Delaware's Regulations Governing Hazardous Waste at the company's New Castle facility. Atlantic Aviation has agreed to pay a $17,500 penalty and to spend at least $80,000 in allowable costs for a supplemental environmental project encompassing a new tank system for managing hazardous waste rinse water.

DNREC notified the company in writing on Feb. 23, 1999 of the alleged violations in a draft Complaint emanating from a Sept. 14, 1998 Hazardous Waste Management Compliance Assessment at the New Castle facility. The alleged violations were corrected during the inspection or soon afterward. Atlantic Aviation and DNREC subsequently agreed to terminate the proceedings and to resolve the allegations with the Settlement and Order.

In addition to paying the penalty, Atlantic Aviation will pay for construction of a tank system to manage hazardous waste (paint and paint solvents) rinse water. The new tank system will replace the company's current practice of container management of rinse water waste. A qualified consultant with independent professional engineer certification will be retained by Atlantic Aviation for the project, known as the Hazardous Waste Tank System Supplement Environmental Project. The consultant will be responsible for design installation and all testing for compliance with the hazardous waste tank regulations for new tank systems.
