SPI Polyols, Inc. Assessed $24,000 Penalty for Water Pollution Violations in New Castle

SPI Polyols, Inc. was issued a Notice of Administrative Penalty Assessment and Order with a penalty of $24,000 Oct. 16 by Department of Natural Resources and Environmental Control Secretary Nicholas A. DiPasquale. The Order was issued to SPI Polyols for discharging pollutants at a level exceeding the conditions of its National Pollutant Discharge Elimination System (NPDES) permit and violations of Delaware's Regulations Governing the Control of Water Pollution.

SPI Polyols, Inc. operates a facility located at Cherry Lane, New Castle, where it produces polyols and has a product development laboratory. Under its NPDES and state permits issued by DNREC in August 1997, SPI Polyols is authorized to discharge noncontact cooling water and stormwater runoff to Magazine Ditch and the Delaware River, subject to effluent discharge limitations, monitoring requirements and other terms and conditions.

DNREC found the company in violation of its permit terms and conditions after SPI Polyols reported in Discharge Monitoring Reports and correspondence for the months of December 1999 and January, February and April 2000 that it discharged pollutants in levels exceeding the effluent limitations for one or more of the parameters established in its permit for Outfall 001.

The company also reported in correspondence to the Department dated April 7, 2000, the non-permitted discharge of 100 gallons of sorbitol and mannitol solution (artificial sweeteners) on April 4, 2000, and that 50 gallons of the discharge entered an on-site stormwater drain that discharges through Outfall 001A. Based on the volume of the discharge, approximately 1,000 pounds of BOD5 (biochemical oxygen demand) was discharged to the Delaware River during the 24-hour period.

In addition to the $24,000 penalty, SPI Polyols was ordered to reimburse the Department $1,000 for recoverable costs incurred in connection with the violation. The company has 30 days to request a hearing on the assessment and Order.
