Jan. 4, 2001 For further information, contact Kathleen Stiller, 302-395-2500; or Melinda Carl, 302-739-4506 DNREC Settles Underground Storage Tank Violations with DelDOTThe Department of Natural Resources and Environmental Control and the Department of Transportation have entered into an agreement regarding DelDOT's violations of Delaware's Regulations Governing Underground Storage Tank Systems. DelDOT was served with a Notice of Conciliation Proceedings, Administrative Penalty Assessment and Secretary's Order March 19, 1999 for the UST violations. A $50,000 administrative penalty was waived by DNREC in lieu of complete compliance. DelDOT continued operating six used oil underground storage tanks out of compliance with the Notice and Order and operated an additional, unregistered used oil underground storage tank. In a March 15, 1999 response to DNREC, DelDOT stated that the tanks would be taken out-of-service by September 1999 and that it would submit a UST registration and notification form to DNREC; DelDOT did not discontinue its use of the used oil tanks until March 28, 2000. Under the settlement agreement signed by DNREC Secretary Nicholas A. DiPasquale and former DelDOT Secretary Anne Canby, DelDOT will pay $25,000 to the Heating Fuel Response Fund for assisting indigent heating fuel tank owners with cleanups. DNREC and DelDOT will also enter into a cooperative information-sharing arrangement between DNREC's Underground Storage Tank Section and the Motor Fuel Tax Administration to more effectively implement the UST program using MFTA and UST databases.
